Temporary and Permanent Civil Protection Orders

Whether you have filed for a restraining order against someone or need assistance for defense, it is very important to have counsel who can assist you in navigating through the process. Some important points to be aware of are:

  • Violation of a civil protection order (restraining order) can be considered a criminal offense.
  • If you are/were in a domestic relationship with the party who filed for the restraining order, then you may no longer be permitted to possess or purchase firearms at least for the duration of the restraining order.
  • If you are/were in a domestic relationship with the party who filed for the restraining order and there is a pending family law matter (divorce, child custody), there may be an opportunity to agree to a “no contact” order in the family law case in exchange for dismissing the restraining order.
  • Having a temporary restraining order filed against you and/or having it become permanent could have negative implications for your future.
