Division of Property - Special Master

In some family law cases, division of property and other issues may not be agreed upon. Although the Courts will attempt to resolve and issue orders regarding any disputes, in certain situations, the parties may require additional assistance. Although the appointment of a special master is considered the exception rather than the rule, one can be appointed by the Court to:

  • Perform duties consented to by the parties.
  • Hold trial proceedings and make or recommend findings of fact under certain circumstances.
  • Address pretrial and post trial matters that cannot be effectively and timely addressed by the appointed district judge.

I have been appointed as a special master to address matters including but not limited to:

  • Dividing large amounts of personal property where the parties were unable to agree on an equitable division.
  • Addressing whether certain items of property should be sold and proceeds divided in the event there were no agreements.
  • Financial matters related to the sale of a home and accounting for other court ordered financial awards such as attorney’s fees and credits for repairs to property for example.
  • Addressing other issues as mandated by the Court or consented to by the parties/attorneys.
