Attorney in Colorado Springs, Extreme Risk Protection Orders

Red Flag Laws - Firearms

If you own firearms, you should be aware that those firearms can be taken from you without notice and due process.

  • The initial filing is called a Temporary Extreme Risk Protection Order or (TERPO)
  • Can be filed by a household, family member, or even law enforcement and is done without notice to you.
  • A hearing may be set to determine whether or not you will be permitted to own or possess firearms or an Extreme Risk Protection Order (ERPO).

The bottom line is the Court could issue an order (TERPO) without notice to you to surrender your firearms. The first time you may hear about this is when the police show up at your door to serve you with the TERPO and then advise you that you need to surrender your firearms to them.

Please keep the following in mind:

  • Failure to comply with a TERPO and surrender your firearms could result in a criminal charge.
  • You have the right to remain silent and anything you say, especially to law enforcement, could be used against you in a future proceeding.
